 General terms and conditions of the Scooter Nest rental agreement

The parties identified in the Rental Agreement are: Scooter Nest SRL, CUI 50244613 (hereinafter referred to as "Lessor"), the Client (hereinafter referred to as "Lessee", Beneficiary, Client, Renter) and the vehicle described in the contract (hereinafter referred to "Vehicle, Scooter or Motorcycle") in accordance with the terms and conditions specified below that the Lessee acknowledges, agrees and by signing undertakes to respect them.

1. Driver's license

The driver's license must be valid and without restrictions, category A, A1, A2 or B125.

It is the Renter's responsibility to ensure that he is authorized to drive the specific model he is willing to rent.

2. Reservation

Scooter Nest will make every effort to provide the reserved vehicle during the rental period. If due to force majeure Scooter Nest is unable to provide the Renter with the reserved vehicle model, an equivalent model may replace the reserved one. If this model is not available, Scooter Nest will refund the rental value of the vehicle. 

3. Pickup and return

The delivery and return of the vehicles must be done at the address, day and time specified in the conditions stipulated in the Rental Agreement.

If the renter wishes to extend the rental period, he must contact Scooter Nest at least 24 hours in advance. Depending on fleet availability, Scooter Nest may or may not authorize an extension at an agreed rate.

Failure to do so without prior notice will be considered the disappearance of the vehicle, which will be immediately reported to the authorities and punished according to law.

Early returns do not entitle the Lessee to receive payment for the missing rental period.

If the scooter is not returned with a full tank, a fee of 100 RON will be charged for the equivalent value of the fuel.

 In case of loss or destruction of documents, a fee of 500 RON will be charged

 In case of loss or destruction of the scooter keys, a fee of 1250 RON will be charged

4. Liability of Scooter Nest

Scooter Nest has to deliver the motorcycle in correct and safe technical conditions for road. The beneficiary must receive the vehicle documents and the chosen accessories.

Scooter Nest has to verify and accept existing damages that are definedin the rental agreement regarding the condition of the vehicle, as part of the handover procedure.

5. Liability of the client

The renter is responsible for ensuring that he is legally entitled to drive a motorcycle. The renter must present a valid driver's license as well as an identity card or passport. The renter is responsible for all fines and penalties and legal fees for traffic violations or other violations of the law during the rental period of the motorcycle. Scooter Nest will charge the Renter any penalty and is responsible for informing the Renter's identity to the authority or any other information regarding the rental agreement.

It is the Lessee's responsibility to ensure that the rented motorcycle:

• It is used according to the manufacturer's recommendations
• It is used in full compliance with the Romanian Road Rules and Codes.
• You will not leave the territory of Romania with a rented motorcycle. 
• Do not use irresponsibly.
• It must not carry more passengers than its approved capacity allows
• Not for racing or competition use
• It is not used off-road, outside conventional roads
• It is not used for illegal purposes
• It must not carry more weight than is allowed.
• It will not be used by anyone other than the Customers named in the rental agreement
• Do not use if its mechanical condition is considered unsafe
• Do not use after consuming drugs or alcohol or other narcotic substances.
• It will not be used when the Client's physical condition is weakened by fatigue or illness.

Failure to comply with any of the preceding paragraphs implies the immediate cancellation of the insurance and the Lessee's responsibility for the total value of the motorcycle and accessories.

6. Procedure in Case of Damage:

The lessee has the obligation to immediately notify Scooter Nest of any new damage discovered on the rented motorcycle.

If the damage has an unknown author, the Lessee has the obligation to obtain, before returning the motorcycle, the Repair Authorization from the Police Authorities.

If the accident was caused by the Lessee's fault and 2 vehicles were involved, he has the following obligations:

• Completing the Amicable Settlement Form if the 2 drivers admit their fault;
• Police Report + Repair Authorization obtained from the Road Police Authorities in case the two drivers do not get along amicably.

If the accident was not the Lessee's fault, and 2 cars were involved, he has the following obligations:

• Completing the Amicable Settlement Form if the 2 drivers admit their fault, copy of the guilty RCA (Compulsory Auto Insurance), copy of the guilty Registration Certificate, copy of the guilty CI (ID documents), copy of the guilty Driving License;
• If the two drivers do not get along amicably, the following will be required: copy of the guilty RCA(Compulsory Auto Insurance), Police Report + Repair Authorization obtained from the Road Police Authorities.

If more than 2 cars were involved in the accident or bodily injuries resulted from the accident, the Lessee has the obligation to contact the Police Authorities to obtain the Police Report + Repair Authorization.

In case of an accident in which an animal was hit, the Lessee has the obligation to notify the Police Authorities as soon as the accident occurred.

In all the cases described above, the Lessee has the obligation to verify the correct completion of both the Amicable Settlement Form, as well as the Repair Authorization and the Police Report issued by the Police Authorities.

In case of non-compliance with the procedure in case of damage, the Lessee is responsible for the entire value of the repairs, the immobilization costs and the costs generated by the lack of use of the motorcycle.

Any new damage that occurs during the rental period of the vehicle will be invoiced according to the repair estimate issued by an authorized motorcycle service, including minor damage, such as scratches.

In the event that the motorcycle returns with new damage, which would reasonably require repairs, Scooter Nest will block the Lessee's damage guarantee upon handing over the Motorcycle, and the amount will remain blocked until the repair estimate is issued by a authorized service. If the value of the estimate exceeds the blocked amount, the Lessee will not be entitled to refund any part of the amount. To the extent that the value of the estimate is lower than the value of the blocked amount, the resulting difference will be returned to the Lessee.

7. Insurance.

The following insurance obligations are included in the rental price.

• Damages and liability for theft in excess of the amount (guarantee/deposit) stated in the rental agreement
• Mandatory auto civil liability

The additional insured amount for damage due to fall or collision as well as for complete loss or theft is established by the security deposit kept by Scooter Nest and specified in the rental agreement.

In any event, this liability covers damage, theft or loss of rental accessories such as helmets, etc.

In any event, the amount in excess of the value is the lessee's maximum liability for damage, total loss or theft.

The insurance policy will automatically be considered void if:

• The renter leaves the scene of an accident in which he was involved.
• The renter does not immediately report the theft or disappearance of the motorcycle or accessories to the authorities and Scooter Nest.
• The rental scooter has been intentionally damaged by the Renter or someone he is responsible for.
• The vehicle is involved in an accident and the Renter does not notify Scooter Nest as soon as possible.
• The vehicle is driven under the influence of alcohol, drugs, narcotics or other narcotic substances
• The vehicle is driven in areas not authorized by Scooter Nest such as unpaved roads and racing circuits or outside the territory of Romania.

8. Mechanical failure

• In the event of a mechanical breakdown, the Renter must contact Scooter Nest stating the exact location and detailed information about the breakdown. If the repair is necessary and possible, you must obtain the consent of Scooter Nest before performing such repair.
• If the repair is not possible, Scooter Nest will attempt to replace the damaged motorcycle as soon as possible.
• Scooter Nest will refund the value of the rental corresponding to the period in which the motorcycle was immobilized due to possible failure. If, for any reason, the replacement is not possible, Scooter Nest will refund the amount paid for the rental days you did not enjoy.
• Refunds or replacement of the motorcycle are excluded if it is due to accidents or mechanical failures caused by falls or careless use of the motorcycle.

9. Cancellation of booking

All bookings made through the Scooter Nest website can be canceled by Scooter Nest or the customer, provided that they are made at least 24H in advance of the rental start date / time. For this, the lessee can contact Scooter Nest at the email address scooternest@gmail.com or at phone number +40 731 90 11 90.

No cancellation fee (except bank charges if applicable) will apply for any cancellation request made before 24h from the rental start date. If the beneficiary does not show up at the date and time of the reservation, and does not inform Scooter Nest of a possible delay, the reservation is considered canceled. 

10. Refund Policy

If possible, refunds will be made in the same way the payment was processed; otherwise, the renter should provide proof of payment as well as their bank account details so that Scooter Nest can make a bank transfer.

Scooter Nest will return all amounts received, with the exception of bank fees, within a maximum period of 5 working days.

No refunds will be made if the customer does not show up to pick up the motorcycle at the time set by the reservation or if the cancellation is requested less than 24 hours in advance. 

11. Disputes

In the event of a dispute between the Lessee and Scooter Nest, it will be settled in accordance with the laws of Romania and both the Lessee and Scooter Nest agree to apply to the courts of Sibiu to resolve any disputes arising from this agreement until their closing.

By signing the Lease Agreement, as well as by placing an order or reservation using the website www.scooternest.ro The Lessee confirms that he has read the General Terms and Conditions of Rent, the Privacy Policy and gives his consent to the use of his personal data, used and processed for the purposes specified above.
